Family of cerebral palsy child compensated by hospital

A family has been awarded seven-figure compensation after eight year legal battle after a hospital error left their son with severe cerebral palsy.

Alfie Johnson nearly died after he was starved of oxygen during delivery after medical professionals failed to appropriately monitor his heart rate.

At Russells Hall Hospital in Dudley West Midlands six weeks after he was born, Alfie was diagnosed with hypoxic-ischemic encephalopathy brain damage.

His parents started legal action in 2008 and the trust admitted liability in 2011, after eight years perusing legal action the family received undisclosed compensation payment on Thursday 5 May.

After the settlement Alfie’s dad Mr Johnson said: “The last eight years have been a nightmare, but this is a new chapter now. We’re going to use the money to get an extension and get Alfie a spa pool. He loves to play about in water, but it’s difficult to get him access to it.

“Alfie is fine in himself, but he can’t walk, he can’t talk, he can’t see or hold his head up.”

Alfie was born November 2007 a healthy baby when going into labour, but the traumatic pregnancy left him severely brain damaged. Mr Johnson claimed that midwifes failed to act during the labour, adding that a senior midwife claimed everything was fine.

Shortly after Alfie was born, doctors informed his parents that he suffering from a seizure due to him being severely brain damaged.

He was later diagnosed with hypoxic-ischemic encephalopathy, following research his parents discovered this was caused by medical negligence.

Mr Johnson said: “They said if a baby is starved of oxygen for ten minutes it causes brain damage, if they are starved for a further 15 minutes it could kill them.

“Alfie came within 30 seconds of dying. It was all preventable. Our baby went into labour healthy, and came out with severe cerebral palsy.”
